THE TOTINO’S SNACKING SWEEPSTAKES RULES

MANY WILL ENTER, FEW WILL WIN.  NO PURCHASE NECESSARY. VOID WHERE PROHIBITED.

1.SWEEPSTAKES: The Totino’s™ Snacking Sweepstakes (the “Sweepstakes”) begins once the Instagram Post goes live on September 20, 2021 and ends 11:59 p.m. Eastern Time (“ET”) September 24, 2021 (the “Sweepstakes Period”).

2.ELIGIBILITY: Open to legal residents of the 50 United States and the District of Columbia, 18 years of age or older as of date of entry, who possess a web-enabled mobile device as of September 19, 2021. Employees of General Mills, Inc. (“Sponsor”), Don Jagoda Associates, Inc., its parents, subsidiaries, divisions, affiliates, suppliers, distributors and advertising, promotional and judging agencies and their respective officers, directors, shareholders, members, employees, agents, assigns, and all others associated with the development, evolvement and execution of this Sweepstakes (collectively “Sponsor and its Administrators”) and the immediate family members of each, are not eligible to participate or win. All federal, state and local taxes are the sole responsibility of winners.

3.HOW TO ENTER: At the start of the Sweepstakes Period, @sceptic will post a photo on Instagram (the “Site”) announcing the Sweepstakes (the “Post”). You may enter on your web-enabled mobile device at the Site by following the instructions in the Post to comment on the Post sharing the first game you’ll pop some Totino’s Minis Pizza Rolls during using #TotinosMiniSweepstakes to receive one (1) entry (“Entry” or “Submission”) into the random drawing.  There is no limit to the number of Entries you may submit, but each Entry must be unique. You must have an Instagram account to enter. If you do not have an Instagram account, and you would like to create one for free, download the free Instagram app to your mobile device at either the Apple® App Store or the Google® Play store. Potential winners may be required to show proof of being the authorized account holder of the email address/Instagram account associated with the Entry. Normal Internet access, phone/usage charges imposed by your online/phone service will apply. All Entries become property of the Sponsor.

4.Submission Requirements: The Submission may not contain obscene, profane, lewd, defamatory or inappropriate text including acts of violence or acts that appear to cause harm or are illegal/dangerous, as determined at Sponsor’s sole discretion. Any Submission or portion thereof that is, in the Sponsor’s sole discretion, obscene, profane, lewd, defamatory, highlights brand in a negative way, contains any third party materials (other than Totino’s), or otherwise violates or infringes (or may infringe) any copyright, trademark, logo, mark that identifies a brand or other proprietary right of any person living or deceased (including, but not limited to, rights of privacy or publicity or portrayal in a false light) or entity, or is otherwise objectionable, will not be considered and may disqualify the Entrant. Entrants may not copy or otherwise plagiarize the Submission from any source. All Submissions must be the sole, original work of the Entrants. By submitting a Submission, you hereby grant the Sponsor, its affiliates, subsidiaries, assigns, licensees, designees and legal representatives the irrevocable, perpetual, worldwide digital and other rights to use, reproduce, edit, market, store, distribute, have distributed, publicly and privately display, communicate, publicly and privately perform, transmit, have transmitted, create derivative works based upon, and promote the Submissions or excerpts of Submissions (as such may be edited and modified by the Sponsor at its discretion) for editorial, commercial, promotional and all other purposes (including posting on Sponsor-affiliated websites, Social Media sites and/or other Sponsor-selected media). In addition, you hereby assign to the Sponsor all rights, titles, and interests that you may be deemed to have in any reproduction, product, or derivative work using or incorporating the Submission. You further agree to waive any moral rights in and to the Submission. Automated, script, macro or robotic Submissions will be disqualified. Instagram is not affiliated with this in any way and is not responsible for the administration of the Sweepstakes or the awarding of the prize. No endorsement or approval of Sweepstakes by Instagram is expressed or implied.

5.RANDOM DRAWING: On or about September 27, 2021, ten (10) winners will be randomly selected from among all eligible Entries received. The random drawings will be conducted by a Sponsor-selected agency, whose decisions are final on all matters relating to the Sweepstakes. Odds of winning the prize are dependent upon the number of eligible Entries received during the Sweepstakes Period. Winners will be notified by DM on Instagram (as further described below). Prizes are nontransferable and no cash substitutions are allowed except by the Sponsor, who reserves the right to award a prize of equal or greater value if advertised prize is unavailable. Winners and all entrants, as a condition of entry into the Sweepstakes/receipt of Prize, agree to release and forever discharge, covenant not to sue, and hold harmless Sponsor and its Administrators from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with submitting an Entry or otherwise participating in any aspect of the Sweepstakes, the receipt, ownership or use of the prize awarded, or any typographical or other error in these Official Rules or the announcement or offering of the prizes.

6.PRIZE AND APPROXIMATE RETAIL VALUE (“ARV”): Prize (10 total): A key board, mouse and mousepad, Totino’s minis product, and Totino’s swag including a hoodie, socks, and fanny pack (ARV: $300 each, Total ARV: $3,000). Acceptance of Prize constitutes permission for the Sponsor and its agencies to use winners’ names, photos and/or likenesses and Entries for purposes of advertising and trade without further compensation, including a winner list, unless prohibited by law. Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor and must be used on date specified. Winners are responsible for all federal, state and local taxes and all other costs and expenses associated with the prize not specified herein as being awarded. No transfer, substitution or cash equivalent permitted by winner.

7.GENERAL RULES/WINNER NOTIFICATION: The Prize winners will be contacted via a direct message on Instagram from @totinos  and will be required to follow the instructions outlined in the direct message to provide their shipping information and hoodie size within twenty-four (24) hours. Return of direct message as undeliverable or return of any prize may result in disqualification and selection of an alternate winner in the manner provided above. Prizes will be awarded within 6-8 weeks after winner verification. By entering in the Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the Sponsor. Sponsor and its Administrators are not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any human error which may occur in the processing of the Entries. The Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the Entry process/pick up of gift cards or the operation of the Site; violates the Official Rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Entries generated by script or bot are not eligible. In the event of a dispute as to the identity of an entrant, the authorized account holder of the Site account submitted at the time of Entry will be deemed to be the entrant. “Authorized account holder” of a Site account is defined as the person who is responsible for joining the Site and who manages the e-mail address associated with the Site Account. The Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Sweepstakes if it is not capable of running as planned, including, but not limited to, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures or any other problems beyond the control of the Sponsor and award the Prizes from among all eligible Entries received prior to cancellation, if any. Prize winners and all entrants, as a condition of entry into the Sweepstakes, agree to release and hold harmless Sponsor and its Administrators, Instagram, and each of their respective affiliates, officers, directors, agents, and employees from any liability or responsibility for any claim arising in connection with participation in the Sweepstakes, pick up of gift cards or Prize awarded. Prize winners assume all liability for any injury or damage caused, or claimed to be caused, by participation in the Sweepstakes, the receipt, ownership or use of any Prize awarded or any typographical or other error in these Official Rules or the announcement or offering of the Prizes. Void where prohibited and subject to all federal, state and local laws. Sponsor is not responsible for any typographical or other error in the printing of the Sweepstakes materials or the offering or announcement of the Prizes. As a condition of entering the Sweepstakes, entrant agrees that: 1) under no circumstance will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential or any other damages, other than for out-of-pocket expenses; 2) all causes of action arising out of or connected with the Sweepstakes or the Prizes awarded, shall be resolved individually, without resort to any form of class action; and 3) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, but in no event, attorneys’ fees. You hereby represent and warrant that you have read these Official Rules and are fully familiar with its contents.

8.WINNERS: For the names of the winners, available after October 15, 2021, send a stamped, self-addressed envelope postmarked by October 31, 2021 to: The Totino’s Snacking Sweepstakes – Winners, 100 Marcus Drive, Attn: DE, Melville, NY 11747.
